New Delhi, July 28: The Supreme Court on Monday stayed a Calcutta High Court order that had blocked the rollout of West Bengal’s updated Other Backward Classes (OBC) reservation list.
A bench headed by Chief Justice B.R. Gavai, along with Justices K. Vinod Chandran and N.V. Anjaria, observed that the high court’s directive appeared “prima facie erroneous” while hearing the state government’s appeal.
Expressing surprise, the bench questioned the high court’s move, remarking, “How can the High Court pass such an order? Reservation is part of the executive function.”

The observations came after senior advocate Kapil Sibal, representing West Bengal, argued that the interim order was unjustified.
The high court had, on June 17, stayed government notifications granting reservation benefits to 140 subcategories under OBC-A and OBC-B.
This revised list was prepared by the state following the high court’s earlier decision in May 2024, which struck down the inclusion of 77 communities from the previous OBC list.
