Big blow to Rahul Gandhi as Jharkhand HC gives nod to continue trial

Ranchi, Feb 23: Congress MP Rahul Gandhi has received a big blow from the Jharkhand High Court today.

The court rejected Rahul Gandhi’s quashing petition while giving its verdict in the defamation case relating to remarks against Amit Shah in 2018.

Now, the trial will be held against the Congress leader in the lower court in the case.

Rahul Gandhi had filed a quashing petition in the high court.  But, as the petition is rejected, a trial will be held against Rahul Gandhi in the lower court in the case of his indecent remarks against Union Home Minister Shah.

The arguments were completed in court on February 9. The case hearing was conducted in the court of Justice Ambuj Nath of Jharkhand High Court.

Advocate Dipankar appeared on behalf of applicant Rahul Gandhi, while senior advocates Ajit Kumar, Vinod Kumar Sahu and Kumar Harsh appeared on behalf of the defendant.

After hearing both sides, the court had reserved the decision. The court gave its verdict on February 20. Today, a copy of the court’s decision was uploaded.

Rahul Gandhi had filed a quashing petition

Rahul Gandhi had challenged the lower court’s order, filing a quashing petition.

Complainant Naveen Jha had filed a complaint against Rahul Gandhi in the lower court of Ranchi.

He had said in his complaint that his sentiments were hurt by Rahul Gandhi’s objectionable remarks against the then national  BJP president Amit Shah.

The lower court had taken cognisance of this matter, which was challenged by filing a petition in the high court.

What is the Issue?

The whole issue concerns making objectionable remarks against the then-BJP President Amit Shah.

In 2018, the Congress General Conference was held in Delhi, during which Rahul Gandhi commented severely on Amit Shah.

He had said that a murderer could become the national president only in the Bharatiya Janata Party (BJP).

On this comment of Rahul Gandhi, a defamation case was filed against him in 2019.

The complainant, Naveen Jha filed a defamation case against the Congress leader, after which Rahul Gandhi filed a criminal quashing petition in the high court.
