CJI Surya Kant to lead Supreme Court collegium after BR Gavai’s retirement

New Delhi, Nov 24: Justice Surya Kant, who has taken over as the Chief Justice of India, will now lead both the five-member and three-member Supreme Court collegiums following the retirement of former CJI Justice B R Gavai on Sunday.

The restructuring of the collegium was initiated immediately after Justice Gavai’s superannuation on November 23.

Under the new composition, the five-member collegium responsible for recommending appointments to the Supreme Court and overseeing high court judge transfers now includes CJI Kant along with Justices Vikram Nath, B V Nagarathna, J K Maheshwari and M M Sundresh.

Meanwhile, the three-member panel for high court appointments will comprise the CJI and Justices Vikram Nath and B V Nagarathna.

Despite Justice Kant’s approximately 15-month tenure, the collegium structure will see only one scheduled change during his term: Justice P S Narasimha will replace Justice Maheshwari after the latter’s retirement on June 28, 2026. Once Justice Kant retires, Justice J B Pardiwala will enter the collegium.

The collegium mechanism remains the established framework for appointments and transfers in the higher judiciary.
