New Delhi, Dec 19: The Delhi High Court on Friday quashed the Lokpal’s sanction that had allowed the CBI to file a chargesheet against Trinamool Congress (TMC) MP Mahua Moitra in the alleged cash-for-query scam.
The bench of Justices Anil Kshetarpal and Harish Vaidyanathan Shankar directed the Lokpal to reconsider the sanction under Section 20 of the Lokpal and Lokayuktas Act within one month, in accordance with proper procedures.
The case revolves around allegations that Moitra sought cash and gifts from businessman Darshan Hiranandani in exchange for raising questions in the Lok Sabha.

The CBI had registered an FIR on March 21, 2024, based on a Lokpal reference, under the Prevention of Corruption Act, and later submitted its report to the Lokpal in July.
Moitra’s counsel argued that the Lokpal’s process was flawed, pointing to Section 20(7) of the Act, which requires obtaining comments from public servants before granting sanction.
The plea also seeks to prevent the CBI from taking any steps, including filing a chargesheet, while the proceedings are ongoing.
The CBI opposed the plea, contending that Moitra is not entitled to submit documents or seek an oral hearing in Lokpal proceedings, and can only provide comments.

Allegations against Moitra include accepting bribes, compromising parliamentary privileges, and sharing Lok Sabha login credentials, which were claimed to pose national security risks.
The Lokpal will now decide the next course of action after reconsidering the sanction.
