Delhi HC rejects PIL to oust jailed Arvind Kejriwal as CM

New Delhi, April 4: Following Arvind Kejriwal’s arrest by the Enforcement Directorate in connection with a money laundering case involving excise policy/ liquor scam, the Delhi High Court on Thursday declined to entertain a Public Interest Litigation (PIL) that sought to remove him as chief minister.

A bench of Acting Chief Justice Manmohan and Justice Manmeet PS Arora emphasized that on occasions, individual interests must take a backseat to national interests.

“At times, personal interest has to be subordinate to national interest but that is his personal call. We are a court of law and have to go by the law. Your remedy does not lie here, it lies elsewhere. You go before the competent forum,” the bench stated.

The bench stated that it had recently rejected a similar Public Interest Litigation (PIL) aiming to oust Kejriwal from the chief ministerial position, therefore, it cannot adopt a divergent stance.

Since the court declined to intervene in the matter, the lawyer representing petitioner Vishnu Gupta stated that he has been instructed to withdraw the petition. He mentioned that he will now take the plea to the Lieutenant Governor instead.

The court resolved the request by permitting the petitioner to retract the petition before disposing of it.
