BJP approaches SC contesting Calcutta HC decision prohibiting ads targeting TMC

New Delhi, May 24: The BJP petitioned the Supreme Court on Friday, contesting a decision by the Calcutta High Court which declined to intervene with a single-judge ruling instructing the party to refrain from publishing any advertisement that breaches the Model Code of Conduct during the Lok Sabha election proceedings.

The advertisements targeted the Trinamool Congress (TMC) party.

Before a vacation bench consisting of Justices Bela M. Trivedi and Pankaj Mithal, the case was mentioned for urgent listing.

Representing the case, Advocate Saurabh Mishra informed the bench that the Calcutta High Court’s division bench issued the order on May 22, restricting the BJP from running advertisements for the Lok Sabha elections until June 4.

Mishra requested the bench to consider the matter on Monday, May 27, to which the bench responded by saying, “Okay, we will see”.

On Wednesday, May 22, a division bench of the High Court refused to interfere with a single-judge’s interim order, thus restraining the BJP from publishing any derogatory or slanderous advertisements against the TMC.

The bench comprising Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharyya stressed the necessity for all political parties to adopt fair electoral practices, noting that the voter is ultimately the main casualty of misleading electoral campaigns.

TMC lodged a petition to prevent BJP from running such advertisements, referencing particular ads published in select newspapers that targeted the Mamata Banerjee-led TMC.
