SC grants interim bail to Arvind Kejriwal in ED case, but will remain in jail in CBI case

New Delhi, July 12: Delhi Chief Minister Arvind Kejriwal has been granted interim bail by the Supreme Court today, Friday, in the liquor scam case.

SC refers ED case to three-judge bench

However, the matter of his arrest by the ED has been referred to a larger bench of the Supreme Court. Kejriwal has challenged his arrest, and now a three-judge bench of the Supreme Court will hear his petition.

According to reports, the Chief Justice will appoint three judges for this case. Kejriwal has been granted interim bail until the larger bench hears the matter.

However, Kejriwal will not be released from jail yet as he is in custody in CBI case; and the bail was granted in the ED case. Therefore, he will remain in jail for now.

Kejriwal’s lawyer, Vivek Jain, stated that the hearing in the CBI case is scheduled for July 18 in the Delhi High Court. Only after the decision in this case can it be determined whether Kejriwal will be released or not.

What did the SC say?

Granting interim bail to Kejriwal, the Supreme Court said that the Delhi CM has been in jail for more than 90 days. He is an elected leader, and the decision on whether he will remain in this position will be made by Kejriwal himself.

The Court also stated that the issue of bail was not examined; rather, the focus was on the standards under Section 19 of the PMLA. There is a need to interpret the rules of arrest under Section 19 of the PMLA.
