Jharkhand News: Garhwa DC directs SAIL to return 228.46 hectares of land in Bhavnathpur

Daltonganj, Aug 8: Garhwa DC Shekhar Jamuar today issued a notice to the General Manager, SAIL / RMD, Bhavnathpur group of mines, to pay the outstanding dues and subsequently to return the land to the government.

The notice invoking provision as enshrined in the Minerals Concession Rules 2016, gives one month to SAIL to act upon the notice so issued or notified today.

The DC has also directed the GM, SAIL, to pay rents, rates and royalties payable under the rules to the government.

The GM, SAIL has also been asked to take down ‘any ore, mineral excavated, engines machinery, plant, building structures, tramways, railways, erections etc’ from the 228.46 hectares of land at Mouja Goreygaon which the SAIL is to return to the government within three months.

State govt to take over excavated minerals if SAIL fails to remove them

“However, if the SAIL fails to take down its excavated ore, minerals, machines, engines plants etc and leave it on the land, then in that case the SAIL’s leftovers will be deemed to become the property of the state government,” the notice has said.

“Thereafter, the state government may sell it or dispose of it in the manner it suits most suitable but the financial proceeds of it will be without liabilities to pay any compensation etc to the SAIL,” the notice added.

SAIL was leased 228.46 hectares of land in 1972

Speaking to this correspondent, DC Shekhar Jamuar said, “SAIL was leased 228.46 hectares of land way back in 1972.”

“Its extended lease expired on 22.10.22. SAIL surrendered the lease to the government,” added Jamuar.

SAIL has to pay Rs 30.42 crore

“Now, under the Minerals Concession Rules, SAIL has been asked to pay outstanding dues worth 30.42 crore to the state government and return the land to the government with or without its inbuilt things like machinery, plant and other things there,” said Jamuar.

Legal sources said the Supreme Court too had passed an order in a case of Common Cause in the context of mine and mineral etc long ago whereupon land is to be vacated or emptied of the inbuilt things.
