New Delhi, April 28: The Supreme Court has issued notice to the Centre, Over-The-Top (OTT) and social media platforms, asking them to respond to a petition seeking the prohibition of sexually explicit content on these platforms.

The bench, led by Justices B R Gavai and Augustine George Masih, acknowledged the seriousness of the issue, noting that it falls under the domain of the executive or legislature.

Justice Gavai remarked that there are ongoing concerns about judicial overreach into executive and legislative functions, stating, “As it is, there are allegations that we are encroaching upon the legislature and executive power.”

The bench asked Solicitor General Tushar Mehta, who represented the Centre, to take action on the matter raised in the petition. Mehta responded that some regulations already exist, with additional measures under consideration.

The petition, filed by five individuals, calls for the establishment of a National Content Control Authority to develop guidelines aimed at banning sexually explicit content on OTT and social media platforms. Advocate Vishnu Shankar Jain appeared on behalf of the petitioners.
