Jharkhand HC: Rules will prevail over job advertisements in assistant teachers’ appointment case

Ranchi, August 20: The Jharkhand High Court has delivered a significant ruling in the ongoing matter concerning the recruitment of Assistant Acharyas (teachers for Classes 6 to 8). The court clarified that in the event of any conflict between a recruitment advertisement and the official rules, the rules will take precedence.

The order was passed by a single bench of Justice Ananda Sen while hearing a petition filed by Rajesh Mistry, represented by advocate Chanchal Jain.

Advocate Jain argued that the Jharkhand Staff Selection Commission (JSSC) had introduced an unlawful condition in its recruitment advertisement. The advertisement stated that candidates must have studied social science subjects for three consecutive years at the undergraduate level.

However, under the Jharkhand Primary School Assistant Teacher (Assistant Acharya) Cadre Rules, 2022, only a bachelor’s degree in the relevant subject is required. The petitioner claimed that this additional criterion was both illegal and arbitrary.

Interim Relief Granted

Recognising the seriousness of the issue, the High Court, in its hearing on August 20, directed that one post under the para-teacher category in the social science subject be reserved for the petitioner until the matter is resolved.

JSSC Given Six Weeks to Respond

The court has also instructed the JSSC to file its reply within six weeks. The ruling is being viewed as an important development for thousands of candidates preparing for recruitment under this cadre.

Reiterating its stance, the High Court made it clear: whenever there is a conflict between the recruitment advertisement and the official rules, the rules will prevail.
