Supreme Court refuses to entertain plea for FIR against Justice Yashwant Varma

New Delhi, May 21: The Supreme Court has refused to hear a petition seeking the registration of an FIR against High Court judge Yashwant Varma in connection with the alleged recovery of cash from his official residence. The court made it clear that the complainant must first approach the appropriate authorities.

A bench comprising Justice Abhay S. Oka and Justice Ujjal Bhuyan, while hearing the writ petition, stated that the Supreme Court’s press release issued on May 8 had already clarified the matter.

The bench observed that the Chief Justice of India had forwarded Justice Yashwant Varma’s response along with the internal inquiry committee’s report to the President and the Prime Minister. Therefore, the petitioner should have first filed their complaint with the competent forum.

The court further said that before seeking a writ of mandamus, the petitioner must make a representation to the proper authorities to resolve the grievance. As such, the court cannot entertain the writ petition. The bench also clarified that there was no need to consider any other prayers at this stage.
