Delhi HC overturns lower court’s decision granting bail to Arvind Kejriwal

New Delhi, June 25: Arvind Kejriwal faced a setback from the Delhi High Court in the Delhi liquor scam case. The High Court said that the subordinate court did not use its mind while granting bail to Arvind Kejriwal in the money laundering case.

While saying that the judge of the court should have given sufficient opportunity to the Enforcement Directorate to present its side while passing the verdict on the bail plea of ​​Arvind Kejriwal, the High Court cancelled the lower court’s decision of granting bail to Kejriwal.

Documents and arguments not appreciated properly by the lower court: Delhi HC

Justice Sudhir Kumar Jain’s bench criticized the decision of the Rouse Avenue Court, maintaining a stay on its ruling. It remarked that the lower court did not exercise its discretion appropriately while granting bail to Arvind Kejriwal.

The Delhi High Court mentioned that both parties (Kejriwal and the Enforcement Directorate) were heard, but the lower court did not scrutinize the documents of the Enforcement Directorate carefully. It did not consider the dual conditions of Section 45 of the Prevention of Money Laundering Act.

The High Court remarked that Additional Solicitor General Raju, representing the ED, raised the issue that the lower court had stated in its order that it was not feasible to read so many documents. This comment was entirely inappropriate. This implies that the trial court did not pay attention to the record.

Notably earlier on June 20, the lower court had granted bail to Kejriwal. Opposing this, the ED approached the Delhi High Court. Subsequently, the High Court had imposed a stay until June 25 for the decision.

SC to hear Kejriwal’s appeal tomorrow

Earlier on Monday, the Supreme Court set June 26 as the date for hearing Chief Minister Arvind Kejriwal’s appeal against the Delhi High Court’s interim stay on his bail in the money laundering case associated with the alleged excise scam/ liquor scam.

A vacation bench comprising Justices Manoj Misra and SVN Bhatti stated that they would wait for the Delhi High Court’s decision on the matter before proceeding further.
