New Delhi, August 7: The Supreme Court on Wednesday deferred to August 28 the hearing on the question whether its 2022 decision upholding the powers of the Enforcement Directorate (ED) to arrest and confiscate property under the Prevention of Money Laundering Act (PMLA) requires reconsideration.
At the start of the hearing, Solicitor General Tushar Mehta, representing the ED, informed the bench of Justices Surya Kant, C.T. Ravikumar, and Ujjal Bhuyan that the review petitions had been suddenly listed and that they needed some time.
Mehta mentioned that the matter had arisen unexpectedly and that more time was needed to prepare. He stated that they were informed about the listing for the hearing only late the previous night and requested that the hearing be postponed to a later date.

Senior advocate Kapil Sibal, representing the petitioners, argued that the 2022 decision was incorrect and needed reconsideration.
The Supreme Court agreed to postpone the case and scheduled the next hearing on the petitions for August 28.
The court was hearing petitions requesting a reconsideration of the three-judge bench’s decision from July 27, 2022, based on certain criteria.
In its 2022 decision, the Supreme Court had upheld the Enforcement Directorate’s (ED) powers under the PMLA concerning the search, seizure of property involved in money laundering, and arrest.
