SC questions fairness of demolishing homes of accused, proposes nationwide guidelines

New Delhi, September 2: The Supreme Court on Monday questioned the fairness of demolishing a person’s house solely because they are an accused.

The Supreme Court expressed its intention to create nationwide guidelines to address the issue of state authorities demolishing the homes of individuals accused of crime as a form of punishment.

A bench of Justices BR Gavai and KV Viswanathan, which is reviewing petitions challenging the “bulldozer actions” in different states, has asked the parties to provide draft suggestions. These will be considered by the Court to develop nationwide guidelines.

“Even if he is a convict, still it can’t be done without following the procedure as prescribed by law,” the bench stated.

The Supreme Court however clarified that it will not safeguard any unauthorized constructions.

“We propose to lay down certain guidelines on a pan-India basis so that the concern with regard to the issues raised are taken care of,” the bench stated.

The Court scheduled the matter for a hearing on September 17.
