Jharkhand HC hears contempt petition on PESA rules, next hearing on Oct 9

Ranchi, Sept 24: The Jharkhand High Court on Wednesday heard a contempt petition concerning the non-implementation of the PESA (Panchayat Extension to Scheduled Areas) rules.

During the proceedings, the state government informed the court that a draft of the rules has been prepared and submitted to the cabinet for approval.

The court also accepted an Interim Application (IA) seeking the removal of the stay imposed on allotments following the auction of the Balu Ghat, and issued notices to the petitioner.

The bench, comprising Chief Justice Tarlok Singh Chauhan and Justice Rajesh Shankar, orally remarked that if the PESA rules are implemented, the court would pass appropriate orders.

The next hearing for the contempt petition has been scheduled for October 9.

The petition was filed by the Adivasi Buddhijeevi Manch. Senior Advocate Ajit Kumar represented the petitioners, while the state government was represented by Advocate General Rajiv Ranjan and Additional Advocate General Jay Prakash.

Manoj Kumar, Secretary of the Panchayati Raj Department, appeared on behalf of the government during the hearing.
