New Delhi, May 5: The Supreme Court on Monday deferred the hearing on a batch of petitions challenging the constitutional validity of the Waqf (Amendment) Act, 2025. The matter will now be taken up on May 15 by a new bench.
According to sources, the bench headed by Chief Justice of India Sanjiv Khanna indicated that the matter requires detailed arguments and cannot be taken up briefly. CJI Khanna also noted that since he is set to demit office on May 13, he would not prefer to reserve orders in the matter.

“I do not want to reserve any judgment or interim order at this stage. This matter will have to be heard on a reasonably early date, and this will not be before me. If you all agree, we will post it before a bench of Justice Gavai,” said CJI Khanna.

The matter was earlier being heard by a three-judge bench comprising Chief Justice Sanjiv Khanna, Justice P.V. Sanjay Kumar, and Justice K.V. Viswanathan.
At the outset of the hearing, Solicitor General Tushar Mehta requested the court to defer the proceedings by a week. The request was accepted by the bench.
The case will now be heard by a new bench to be headed by Justice B.R. Gavai, who is designated to take over as the next Chief Justice of India.
