SC stays Calcutta HC’s order on invalid appointments in West Bengal schools

New Delhi, May 7: The Supreme Court on Tuesday halted the implementation of the Calcutta High Court’s ruling from April 22, which had declared the appointments of 25,753 teachers and non-teaching personnel in state-run and state-aided schools of West Bengal as invalid.

A bench consisting of Chief Justice DY Chandrachud and Justices JB Pardiwala and Manoj Misra expressed that as the questionable appointments can be separated, it would not be prudent to invalidate all the appointments altogether.

The Supreme Court, however, mandated that the salaries of the unlawfully appointed individuals must be reimbursed.

Additionally, it permitted the CBI to proceed with the investigation as directed by the High Court’s order. Nevertheless, the court instructed the investigative agency that no immediate and coercive action could be taken against the accused which includes the candidates and West Bengal government officials.
