Kolkata, Feb 7: The Calcutta High Court on Friday admitted the CBI’s appeal seeking capital punishment for Sanjay Roy, the sole convict in the RG Kar hospital rape-murder case, while rejecting a similar plea from the West Bengal government.
The division bench of Justices Debangsu Basak and Md Sabbar Rashidi stated that since the CBI was both the investigating and prosecuting agency, its challenge to the trial court’s life sentence till death for Roy would be considered.
The state government had argued that it also had the right to appeal against the perceived inadequacy of the sentence, but the court dismissed its plea.

The CBI and the West Bengal government both appealed to the high court, demanding the death penalty for Roy.
On January 20, the Sealdah Civil and Criminal Court sentenced the accused Sanjay Roy to life imprisonment and imposed a fine of ₹50,000.
The case pertains to the alleged rape and murder of a postgraduate medical trainee on August 9 last year, whose body was found in a seminar room at the RG Kar Hospital in Kolkata.
The main accused Sanjay Roy, a civic volunteer with the Kolkata Police, was arrested the day after the incident. The case was handed over to the CBI for investigation.
