CPI challenges Waqf Amendment Act in Supreme Court

New Delhi, April 14: Challenging the constitutional validity of the Waqf (Amendment) Act, 2025, the Communist Party of India (CPI) has approached the Supreme Court.

In a writ petition filed by its general secretary D Raja, the CPI argued that the Amendment grants excessive control to the Central government over the Waqf Board, infringing upon fundamental rights protected under Articles 25, 26, and 29 of the Constitution.

Filed through advocate Ram Sankar, the plea contends that the Amendment Act — notified on April 5 following presidential assent — severely restricts the Waqf Board’s autonomy and significantly alters the original framework established under the Waqf Act of 1995.

The CPI further asserted that despite strong public opposition, the Centre pushed the legislation through Parliament without seriously addressing objections raised by the Joint Parliamentary Committee and other stakeholders.

Several other petitions challenging the new Waqf law on various constitutional grounds are already pending before the apex court. A bench headed by Chief Justice of India Sanjiv Khanna is scheduled to hear all related matters on April 16.
