The ED has challenged a trial court order that had refused to take cognisance of its complaint against Sonia Gandhi, Rahul Gandhi and others. Solicitor General Tushar Mehta appeared for the ED and advanced arguments before the High Court.

The case arises from the trial court’s December 16 order, in which it held that the ED’s complaint could not be entertained as it was not based on a first information report (FIR). The trial court observed that cognisance could not be taken on the basis of a complaint filed by a private individual.

In its chargesheet, the ED has named Sonia Gandhi, Rahul Gandhi, Sam Pitroda, Suman Dubey, Sunil Bhandari, Young Indian and Dotex Merchandise Private Limited. The Congress has termed the proceedings as an act of political vendetta.
